1. About TopMark Academy
TopMark Academy provides HSC-style mock examinations, marking, feedback, performance analysis and educational support services for students preparing for their HSC examinations.
By registering for a TopMark Academy examination package, the student and, where applicable, their parent or guardian agree to these Terms & Conditions.
2. Examination Packages
Each subject package is priced at $299.95 AUD and includes two full-length HSC-style mock examinations, detailed tutor feedback, an online tutor consultation and a personalised performance report.
Students may register for one or multiple available subjects. Each selected subject is charged separately.
3. Registration
Registration is only considered complete once the required registration information has been submitted and payment has been successfully processed.
Students will receive their examination schedule after registration. Students are responsible for checking their schedule and attending their allocated examination sessions.
4. No Change-of-Mind Refunds
Payments for examination packages are non-refundable for change-of-mind reasons once registration has been confirmed.
This includes circumstances where a student subsequently decides not to participate, changes their study plans, chooses another provider or is otherwise unable or unwilling to complete the program.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under applicable Australian Consumer Law.
5. Examination Attendance
Students are expected to attend their scheduled examination sessions and arrive prepared to commence at the designated time.
Students who are unable to attend an examination should contact TopMark Academy as soon as reasonably possible. Any alternative arrangements or rescheduling are subject to availability and are not guaranteed.
6. Examination Conditions
TopMark Academy examinations are designed to replicate the timing, structure and conditions of the corresponding HSC examinations as closely as reasonably possible.
Students must complete examinations independently and must follow all instructions provided by TopMark Academy tutors and staff.
Unauthorised assistance, collaboration, communication or use of prohibited materials may result in the student's examination being cancelled or their results being withheld.
7. Copyright and Ownership of Examination Materials
All examination papers, questions, solutions, marking materials, feedback documents, report templates and other educational resources provided by TopMark Academy remain the intellectual property of TopMark Academy or their respective rights holders.
Students receive a limited, personal and non-transferable right to use examination materials for their own educational purposes.
Examination papers and other TopMark Academy materials must not be copied, reproduced, photographed, screen-recorded, uploaded, published, distributed, sold, shared or provided to another person without prior written permission from TopMark Academy.
This restriction applies both during and after participation in the TopMark Academy program.
8. Sharing and Distribution of Materials
Students must not upload TopMark Academy examination papers, questions, solutions, screenshots or other proprietary materials to social media, messaging platforms, websites, online forums, file-sharing services or other third-party platforms.
Students must not sell, distribute or otherwise provide TopMark Academy materials to other students or educational providers.
9. Marking and Feedback
Examination responses are marked using criteria designed to reflect relevant HSC marking expectations.
Feedback is intended to help students identify strengths, areas for improvement, examination technique issues and opportunities for further study.
TopMark Academy reserves the right to correct administrative or marking errors where they are identified.
10. Performance Reports
Performance reports may include examination marks, topic-by-topic analysis, strengths and weaknesses, cohort ranking, time-management analysis and personalised revision recommendations.
Rankings and performance comparisons are based on the participating student cohort and should not be interpreted as official NESA rankings.
11. HSC Results Disclaimer
TopMark Academy provides mock examinations and educational feedback to assist students with HSC preparation.
Participation in TopMark Academy does not guarantee a particular HSC mark, band, ATAR or academic outcome.
Any estimated HSC ranges, readiness ratings, rankings or predicted performance provided in reports are indicative only and should not be considered guarantees of future examination results.
12. Tutor Consultations
Each subject package includes an online tutor consultation. Consultation arrangements will be communicated to students after completion of the relevant assessments.
Students are expected to attend their scheduled consultation. Rescheduling is subject to tutor availability.
13. Secure Payments
Payments are processed using the payment services made available by TopMark Academy.
TopMark Academy does not intentionally store complete payment card details on its own website or registration system where the payment provider processes those details directly.
Students should ensure that payment information is entered only through the official TopMark Academy registration and payment process.
14. Privacy
Information collected during registration may include student, parent or guardian contact details and information required to administer the program.
Information will be used for purposes including registration, scheduling examinations, communicating with students, providing feedback and delivering TopMark Academy services.
15. Changes to the Program
TopMark Academy reserves the right to make reasonable changes to examination schedules, tutors, examination locations, online arrangements or other program details where necessary.
Where a significant change affects a student's participation, TopMark Academy will endeavour to communicate the change as soon as reasonably possible.
